Responsibility for the protection of your personal data

In compliance with articles 6, 16 and 73 of the Political Constitution of the United Mexican States y en lo previsto en la Federal Law for the Protection of Personal Data in Possession of Individuals, and the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, in order to regulate the legitimate, controlled and informed treatment of personal data in possession of individuals as well as to guarantee the privacy of individuals and their right to informational self-determination, we wish to inform you of the following: the Centro de Energía Renovable y Calidad Ambiental Asociación Civil (hereinafter, "CERCA A.C."), with address at C. Chiapas 3865, Las Palmas, 23070, Municipality of La Paz, Baja California Sur, will be responsible for the treatment of personal data provided by the owner.

CERCA A.C., keeps with strict confidentiality the personal data collected directly from the Data Subject with his/her full consent, and complies with the necessary security measures to protect such information and guarantee the integrity, confidentiality and availability of the personal data, preventing its loss, transmission or unauthorized access.

Purpose of processing and personal data collected

The personal information that CERCA A.C. may collect will be: (i) identification data; (ii) contact data; (iii) patrimonial data; (iv) financial data; (v) academic data; and, (vi) employment data. CERCA A.C. does not request sensitive personal data.

CERCA A.C. will be able to carry out national or international transfers of the data, without the consent of the holder when any of the following cases occur: (i) it is foreseen in a Law or Treaties to which Mexico is a party; (ii) it is carried out to controlling companies, subsidiaries or affiliates under the control of CERCA A.C., to a parent company as well as to its associates or donor institutions; (iii) it is necessary by virtue of a contract celebrated or to be celebrated in the interest of the holder, by CERCA A.C. and a third party; (iv) it is necessary or legally required to safeguard a public interest, or for the procurement or administration of justice; (v) it is necessary for the recognition, exercise or defense of a right in a public interest or for the administration of justice. and a third party; (iv) is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice; (v) is necessary for the recognition, exercise or defense of a right in a judicial process; and, (vi) is necessary for the maintenance or fulfillment of a legal relationship between CERCA A.C. and the holder.

By providing your Personal Data by phone or through an application, call, paper format, digital format, email, web page contact form, social networks or any other means or document, you accept and authorize CERCA A.C., to use and treat your personal data and information provided in an automated way. to use and treat in an automated way your personal data and information provided, which will be part of our database in order to use them to: identify you, locate you, contact you, send you communications, invitations, calls, information or goods, as well as for historical and statistical purposes.

Revocation of Consent and Exercise of ARCO Rights

The temporality of the handling of your Personal Data will be indefinite from the date you provide it. The Holder of the information will have the right to request access, rectification, cancellation and opposition (ARCO Rights) as stipulated in articles 22, 23, 24, 25, 26 and 27 of the Federal Law for the Protection of Personal Data in Possession of Individuals as well as to limit the use or disclosure of their data, or revoke the consent granted, by express request in accordance with articles 28 and 29 of said Law, via email addressed to C. Jaqueline Valenzuela Meza (jacqueline@cerca.org.mx), who in accordance with Article 3 Section XIV and Article 6 of the Federal Law for the Protection of Personal Data in Possession of Individuals, will be responsible for the treatment of personal data in possession of CERCA A.C., attending the ARCO Rights on behalf of the Data Subject, or in writing presented at the address previously indicated in this Privacy Notice, which must be accompanied by the documents that prove the identity of the Data Subject (official identification with photograph) or in its case the legal representation of the Data Subject in terms of the common legislation.

The response to the requests that comply with the aforementioned requirements may be notified to the promoter via e-mail (when the e-mail address is provided), by courier or by fax, within a period of no more than 20 business days from its receipt, in accordance with Article 32 of the Federal Law for the Protection of Personal Data in Possession of Individuals. It is important to mention that the exercise of any of the aforementioned rights is not a prerequisite nor does it prevent the exercise of any other right.
